Ms Goldstein on Tenure

I think that Dana Goldstein has a really good view on tenure:

Indeed, the Green Dot model calls for teams of teachers to be actively involved in hiring their peers; this is a highly-vetted workforce operating in an environment that emphasizes collegiality and professionalism. Without such healthy school envirnments, unions and teachers will have a hard time giving up the tenure protections they've won because of a very real history of adminstrative overreach.


I see this issue as being very similar to online education. My department has a very strong online graduate program. Contrary to all predictions, moving education to an online environment takes a lot of work and isn't as effective at improving productivity as one might imagine. It's possible to do a high quality online program, but it sure isn't inexpensive or easy.

In the same sense, the idea of removing tenure and leaving effective (albeit different) schools has a lot of the same properties. By increasing teacher empowerment, involving teachers in decisions, and increasing compensation you can develop a workable model. After all, tenure is a job perk and it can be replaced by other job perks like employee autonomy and empowerment.

But what the removal of tenure isn't is a cheap way to reduce teacher salaries while holding quality constant. I am agnostic as to the existence of tenure in a workplace. It is a nice perk but it brings downsides as well. What I find more alarming is the effort to remove tenure and replace it with . . . nothing. Or, even worse, replacing nuanced teacher review with test scores (and then removing tenure).

I admit to being very sympathetic to empowered workplaces. My natural work environment is likely the Left Coast and reading about the corporate culture of Silicon Valley convinced me that I'd do better there than in Boston. But these environments are not a cheap and easy substitution for conventional models. They are hard to develop and really require that the employees be either mobile or empowered.

Is that a goal reformers really want to work towards?

One more thought

Mark, Andrew Gelman and I have all weighed on on the article written by David Rubinstein. So I think the high points have been hit.

One thing that I think was interesting, though, was his decision to be defiant about his career. Comments like:

Why do I put “worked” in quotation marks? Because my main task as a university professor was self-cultivation: reading and writing about topics that interested me. Maybe this counts as work. But here I am today—like many of my retired colleagues—doing pretty much what I have done since the day I began graduate school, albeit with less intensity.


Seemed to me to be extremely revealing. I think that one possibility is one of culture. I grew up in a social democracy and I would feel shame if I thought I was "milking the system". My father used to explain the low Swedish unemployment rate to me as being a cultural phenomeon (in Sweden the shame of not working is high).

On the other hand, I occasionally see people bragging about how they bilked the system as if this is a point of pride and not deep humiliation. I wonder if there is a cultural divide here as I would find behavior to be shameful. Consider this statement:

Committee meetings were tedious but, except for the few good departmental citizens, most of us were able to avoid undue burdens.


Why would he not be ashmaed not to have been a good departmental citizen? I am always worried that I am not carrying enough administrative burden in my department and concerned when another faculty member is overloaded.

Or this comment:

To be sure, some of my colleagues were prodigious researchers, devoted teachers, and outstanding departmental, university, and professional citizens. But sociologists like to talk about what they call the “structural” constraints on behavior. While character and professional ethics can withstand the incentives to coast, the privileged position of a tenured professor guarantees that there will be slackers.


So why are character and professional ethics not valued? Why does an confession as to a lack of professional ethics sound like an attack on the profession and not an admission of a personal failing. Mark pointed out the comments on his teaching ability and I have to admit it sounds like he wasn't the most focused professor ever.

Or perhaps I misunderstand some parts of this situation??

University Professor Compensation

Andrew Gelman links to college professor David Rubinstein who makes a number of inflammatory comments under a headline that includes "Thank you, Illinois taxpayers, for my cushy life":

After 34 years of teaching sociology at the University of Illinois at Chicago, I [Rubinstein] recently retired at age 64 at 80 percent of my pay for life. . . . But that's not all: There's a generous health insurance plan, a guaranteed 3 percent annual cost of living increase, and a few other perquisites.


In my 34 years, just one professor in the sociology department resigned to take a nonacademic job. For open positions, there were always over 100 applicants, several of them outstanding. The rarity of quits and the abundance of applications is good evidence that the life of the college professor is indeed enviable.


Protests against efforts to reform pay scales, teaching loads, and retirement benefits employ a “solidarity forever, the union makes us strong” rhetoric. What these professors and other government workers do not understand is that they are not demanding a share of the profits from the fat-cat bourgeoisie. They are squeezing taxpayers—for whom the professors purport to advocate—whose lives are in most cases far harsher than their own.


I have a few comments to make about this particular issue. First of all, I notice that the professor in question is happy to brag about his success but is not proposing, for example, to stop accepting his pension. I am not sure why it makes sense to mock the people who support one's financial position. Is it considered good sense to mock customers in business?

Second, there are a lot of people in all fields of endeavor who do not earn their salary. What is it about academics that makes people think it might make sense to brag about being a poor performer?

Third, why is the focus on the cost to the taxpayer for academic pensions a focus? We subsidize a lot of activity -- for example, we tax hedge fund managers at captial gains tax rates. This is a very important subsidy on that activity but we do not hear comments about how hard it is for people in the working class to subsidize multi-billion dollar incomes.

I think Andrew Gelman makes the winning point here:

David Rubinstein appears to be somewhat of an extreme case of the underworked and overpaid professor: he taught at a low-ranked but high-paying institution, he got his Ph.D. at a time where they were giving out tenure-track slots like candy canes at Christmas, he (by his own admission) spends a total of less than one hour per week on class preparation, grading, and advising combined, and he got a contract in an era with generous retirement benefits.


It is unclear to me what action makes sense here, given these issues. Clearly, attacking current new professors does not seem to address the core issues (that David Rubinstein was hired in an exceptional era). It can only hurt people who have had to struggle up under much more difficult circumstances than he has. Which seems to be identical to his critique of academics in general (that they are priviledged and don't care about people who have had to deal with more difficult life circumstances).

I do know that my own experience of university life is completely different. I am in a resaerch position and I still spend a lot more time on teaching then he does, not to mention leading student research groups. My pension is defined contribution and my pay has just been cut as part of a state-wide austerity movement (after 1 year, that time when compounding means cuts hurt the most). It's hard work but I like the job. I do know that when I worked in industry, pay was higher and life was a lot less stressful.

It is a very odd article.

"This is an egregious example of a public university being willing to sell itself for next to nothing."

Yeah, 'egregious' is what I'd go for (from the St. Petersburg Times via Chait):

A foundation bankrolled by Libertarian businessman Charles G. Koch has pledged $1.5 million for positions in Florida State University's economics department. In return, his representatives get to screen and sign off on any hires for a new program promoting "political economy and free enterprise."

Traditionally, university donors have little official input into choosing the person who fills a chair they've funded. The power of university faculty and officials to choose professors without outside interference is considered a hallmark of academic freedom.

Under the agreement with the Charles G. Koch Charitable Foundation, however, faculty only retain the illusion of control. The contract specifies that an advisory committee appointed by Koch decides which candidates should be considered. The foundation can also withdraw its funding if it's not happy with the faculty's choice or if the hires don't meet "objectives" set by Koch during annual evaluations.

David W. Rasmussen, dean of the College of Social Sciences, defended the deal, initiated by an FSU graduate working for Koch. During the first round of hiring in 2009, Koch rejected nearly 60 percent of the faculty's suggestions but ultimately agreed on two candidates. Although the deal was signed in 2008 with little public controversy, the issue revived last week when two FSU professors — one retired, one active — criticized the contract in the Tallahassee Democrat as an affront to academic freedom.

Rasmussen said hiring the two new assistant professors allows him to offer eight additional courses a year. "I'm sure some faculty will say this is not exactly consistent with their view of academic freedom,'' he said. "But it seems to me it would have been irresponsible not to do it."

The Koch foundation, based in Arlington, Va., did not return a call seeking comment.

Most universities, including the University of Florida, have policies that strictly limit donors' influence over the use of their gifts. Yale University once returned $20 million when the donor demanded veto power over appointments, saying such control was "unheard of."

Jennifer Washburn, who has reviewed dozens of contracts between universities and donors, called the Koch agreement with FSU "truly shocking."

Said Washburn, author of University Inc., a book on industry's ties to academia: "This is an egregious example of a public university being willing to sell itself for next to nothing."

Over the past few years we have seen the undermining (often deliberate) of the independence and credibility of a number of important institutions -- universities, research labs, government agencies, think tanks. It has been done through funding with increasingly less subtle strings attached, through attacks on academic freedom and independence (anyone for tenure reform?), and through a full court press on a media that has been all too willing to play the toady and the fool.

It's easy to see the short-term benefits of this erosion for people who, say, are trying to ignore evidence of climate change or the relationship between tax rates and budgets over the past twenty years, but in the long-term, when we lose our sources for reliable information and analysis, there are no winners.

p.s. I'm opening the floor for nominations. Can anyone suggest a more weaselly phrase than "I'm sure some faculty will say this is not exactly consistent with their view of academic freedom''?

"Academic Intimidation"

One of the reasons we have tenure is to protect the intellectual independence of academicians. If you think they no longer require that protection, you haven't been paying attention.

From Paul Krugman:

Regular readers may recall my praise for William Cronon’s Nature’s Metropolis: Chicago and the Great West, a great book that had a big influence on my work in economic geography. Cronon has inspired many other people; Josh Marshall was deeply influenced by his environmental history of New England. Cronon, who teaches at the University of Wisconsin, is, quite simply, a great historian.

He also feels some duty as a citizen, in particular a citizen of his state. So earlier this week he published an op-ed in the Times condemning the power grab by the state’s governor.

And what happened next? Wisconsin Republicans have demanded access to his personal email records.

Yes, personal. Cronon has a wisconsin.edu email address — but nobody, and I mean nobody, considers such academic email addresses something specially reserved for university business. Actually, according to Cronon he has been especially careful, maintaining a separate personal account — but nobody would have considered it out of the ordinary if he mingled personal correspondence with official business on the dot edu address. And no, the fact that he’s at a public university doesn’t change that: when my students take jobs at Berkeley or SUNY, they don’t imagine that they’re entering into a special fishbowl environment that they wouldn’t encounter at Georgetown or Haverford.

But then, we know perfectly well what’s going on here. Republicans aren’t looking for some abuse of Cronon’s position; they’re hoping to find some statement that can be quoted out of context to discredit him. At the very least, they hope that other academics will henceforth feel intimidated...

Teachers are nervous about Michelle Rhee's suggestions because they're afraid other people in power will act like Michelle Rhee

The debate over job security for teachers is often employs an analog of the "If you're not hiding something..." argument in national security. Just as those who are guilty of nothing are supposed to have no reason to object to searches and wiretaps, teachers who are effective and conscientious have nothing to fear from the elimination of tenure and LIFO.

The argument works on two levels: it has a convincing though overly simplistic logic and it casts aspersions on the competence and character of those who object to it.

Of course, it collapses completely if those with the power to hire and fire ignore educators' accomplishments, make arbitrary and opaque decisions, play politics, let small factions gain undue influence over the process.

Oyster-Adams Principal Marta Guzman can recall the ripple of anxiety that ran through some faculty members last summer when they learned that the new D.C. schools chancellor, Michelle A. Rhee, had chosen the bilingual school for her two daughters, a kindergartner and a third-grader.

But Guzman, an educator with more than 30 years' experience, said she wasn't concerned. The dual-immersion program, where native English and Spanish-speaking children learn side by side, has long made the Cleveland Park school among the city's most coveted, with high test scores and a national Blue Ribbon for academic achievement. Every year, parents from outside its attendance boundaries vie through a lottery for a handful of spaces to enroll their children.

"I thought it was a good thing," she said of the Rhee children's enrollment.

This week, Rhee fired her.

Guzman received a form letter from Rhee informing her that she was out of a job effective June 30, one of at least two dozen principals whose contracts for the 2008-09 school year were not renewed. Guzman said she was given no reason for her dismissal, either in the letter from Rhee or at a Monday meeting with Assistant Superintendent Francisco Millet.

Guzman's departure has stunned many Oyster-Adams parents who wonder why, in a city filled with under-performing public schools, Rhee would sack a principal who has presided for the past five years over one of its few success stories. The move has also heightened ethnic and class tensions within the school's diverse community. Eduardo Barada, co-chairman of the Oyster-Adams Community Council, the school's PTA, said Guzman was toppled by a cadre of dissatisfied and largely affluent Anglo parents with the ear of a woman who was both a fellow parent and the chancellor.

"I believe there are some parents who want to control and dominate," he said. "They want to silence the Latinos there."

Claire Taylor, council co-chairwoman, said she "absolutely respects Eduardo's position" but doesn't agree with it. "From what I've seen of Michelle Rhee, she is an exceedingly fair person who wants what's in the best interests of the students," she said.

Taylor added that ethnic and class divisions are the norm at Oyster-Adams. "A leaf falls and there are issues," she said.

Taylor was one of a group of Oyster-Adams parents, both white and Latino, who dined with Rhee in November and aired complaints about Guzman. Among the issues raised with Rhee, who took notes, according to another attendee, were Guzman's alleged lack of organization, reluctance to delegate and sometimes-brusque style.

Asked to discuss the dinner, which was at the home of another parent, Taylor said she was "not going to get into intra-school politics."

The first sign that her job was in jeopardy, Guzman said, came last month, when Millet convened a meeting of Oyster-Adams teachers to discuss her leadership. Guzman, who was not invited to the meeting, said she learned from a teacher that Millet began the meeting by announcing that a national search was underway for her replacement.

She quickly asked for a meeting with Rhee, who told her about the dinner meeting. Rhee said parents were frustrated by Guzman's lack of organization and "not comfortable with her" on a personal level.

Maureen Diner, who has a fourth-grader at the school, said Rhee's silence is not seemly for a chancellor who came into office a year ago promising reform.

"Anybody asked not to return deserves a process, at the very least a community meeting," Diner said. As for Rhee, "she talked about creating a culture of accountability. At the same time, she needs to be accountable for her own actions."
I wish I could say I was shocked to read this, but I can't. I can't tell you that this sort of politics is unusual. I can't even claim that this is my first encounter with a dinner party putsch.

At the risk of putting too fine a point on what is already a damned sharp spike, a group of parents who invite the chancellor of a major metropolitan school district over for dinner will not, as a rule, be poor, simple, honest workin' folk. They will tend to be wealthy, influential and grossly unrepresentative. To accept their invitation at all showed exceptionally poor judgement. To fire one of the district's most effective administrators based on their influence showed none whatsoever.

Of course, under the current system, teachers have protections that principals don't. They can give poor grades for poor work, keep the wooden and the clumsy in the chorus and the second string respectively, write honest evaluations. They can, and often will, be harassed for doing their jobs but they aren't in danger of losing them.

At least for now.

Tenure and the end of mandatory retirement (Canada edition)

Frances Woolley has a nice post about the intersection between tenure and the lack of a mandatory retirement age in Canada. It is a different case than the debate in Canada. The background is that salary scales and tenure agreements (at Canadian Universities) were negotiated when there was a mandatory retirement age of 65. The removal of mandatory retirement was a windfall for professors who were already employed as they work under a salary scale designed for workers who would leave at 65.

In practical terms this can have a fairly important impact on budgets as it adds additional years of salary at the highest levels (often 2.5 x starting salary in a Canadian University). Frances has a nice chart here. The short term implications are stark:

Such a pay structure can be profitable as long as the pay structure is similar to the one shown in the diagram above, where the high costs of paying workers between 45 and 65 are counter-balanced by the low cost of paying workers between 25 and 45. But if the terms of the employment arrangement were changed so that workers stayed on until 75, the firm's pay structure would no longer be profitable: the costs of paying experienced workers more would exceed the gains from underpaying junior workers.


I think that there is an important balance between job security and balancing out employment contracts. In this case, due to regulatory changes, I think it would make a lot more sense if tenure elapsed at the traditional retirement age. In this case we have the reverse of what is happening in the United States for teachers -- the employment contract changed in mid-stream. I think it is consistent to argue, in both cases, that a change of contract terms should not result in a windfall for either party unless the change was by mutual consent.

Academics

Female Science Professor has an absolutely delightful take down of a Andrew Hacker and his book:

My vote for the strangest part of the book is the paragraph in which the authors describe a "workingman" who "jumped on a subway track to rescue a child who tripped and fell." The workingman didn't think; he just did it. The authors posit that professors on that same platform would not have jumped on the track to save the child:

"We wonder if, had some professors been on the platform, would they have paused to ponder how John Stuart Mill might have parsed the choices?"

I wonder if that is a sane thing to wonder. Of course the professors would save the child. What better way to combine broader impacts, a synergistic activity, and outreach?

Similarly, what is your evidence for your contention that professors don't work as much as they say they do? This seems to be it: "A story is told of a classroom where all the students were busy scribbling as the professor droned on. All, that is, but one, a young woman in the back row, who wrote down nary a word. How so? She had with her the notes that her mother had taken for that class during her own student days." That's the evidence? A possibly apocryphal story?

For example, your book starts with the story of a candidate who, in his interview for a faculty position, makes it clear that he is not interested in teaching and is only interested in research. The fact that he was not hired indicates to me that the system worked well, yet you used this anecdote to illustrate your hypothesis that professors don't care about teaching and try to do as little of it as possible.


There are a lot more really good examples in this text, these were just my favorites. It is definitely worth an afternoon read.

Education Reform

I want to very quickly return to first principles. When Mark and I began discussing tenure reform, it was in the context of a "crisis" in education. This terminology continues to this day.

However, the real impact of recent news is that proposed reforms don’t have the potential to make immediate and dramatic improvements in education outcomes. Why does this matter?

Because if there is an incipient crisis and known strategies can directly address them then it would be grossly unethical not to try and address this in the fastest way possible. However, if there is not an immediate crisis the correct way forward is one that addresses all of the stakeholders and not radical top-down driven reform. In other words, Baltimore and not Washington, DC.

In the long run educational reform may be inevitable and positive. One of our well versed commentators (Stuart Buck) opined about the evidence:

It's consistent with any number of stories, including increased quality of teaching, better curriculum, finding a better fit for each individual students (some do better in a smaller school, for example), and the factors that you mention.


In my view, this suggests that we are going to experiment with news modes of education. After all, many people who I respect are strongly advocating for experimenting further with education reform (Jon Chait, Megan McArdle, Matt Yglesias, Alex Tabarrok come immediately to mind).

So why are there concerns about the process by which educational reform is occurring? Because, the discussion began with a question of where to allocate resources. Seyward Darby was arguing that we needed to accept teacher layoffs as part of the price if educational reform:

The president's beef is with a provision to prevent teacher layoffs, which Democrats tacked onto the bill along with several other domestic priorities. To pay for the measure, the House agreed to cut money from some of the president's key education reform initiatives. Obama isn't happy about it. Nor should he be.


Now, if there is a real and immediate crisis in education than, of course, dramatic measures can make sense. But is this really the time to spark a round of teacher layoffs in order to make slow improvements in who decides to apply for teaching jobs? Maybe, but it seems naive to think that we should fuel the testing of educational reform with layoffs at this precise moment. Readers of Felix Salmon may remember this week's jobs report:

Meanwhile, as the school year begins, we have this:

Employment in local government decreased by 76,000 in September with job losses in both education and noneducation.


As states and municipalities around the nation start running out of money, they’re going to fire people; this is only the beginning. And if October is any indication, the job losses in the local government sector are going to be at least as big as the job gains in the private sector.


So the real issue is whether this is the time for radical teacher employment restructuring -- should we lay off teachers to test educational reform? We do have a duty to the future but we also have a duty to the current students as well. The conversation would be different if the net resources for education were increasing but claiming that education is a priority in the midst of layoffs due to lack of funding seems disingenuous.

My interest in this subject grew from two arguments in the blogosphere. One, that the crisis in educational was so bad that the state should massively break contracts without cause. Notice that in cases like AIG and TARP, we were willing to spend a lot of money as a society to preserve financial contracts. Two, that reform has likely to be so important that teacher lay-offs in the midst of a recession were an acceptable sacrifice as the students would be better off.

If we don't accept that there is an immediate crisis then we can still move forward. But then it becomes an American-style bottom-up reform and not a Soviet-style top down reform. I like the Baltimore example -- specific communities negotiating ways to respond to the crisis and continuing to try ways to create a better future for their children. The result of a thousand experiments with engaged communities could very well result in a far better educational system in the long run.

And I think that is a good outcome.

Forget teachers, what does it take to fire an incompetent corporate employee?

We have often heard (and I do mean often) that schools need to emulate the firing practices of corporations and promptly fire the incompetent regardless of tenure with the institution.

One of the flaws with this suggestion is that corporations don't actually do this. Anyone who has built attrition models for a large company can tell you that, unlike layoffs, firings of employees with more than four years of tenure are extremely rare. Defenders of corporate practices would argue that those employees who make it to the four year mark are almost all competent, that pretty much everybody you'd want to fire has quit or been fired by that time.

The trouble with this defense is that, though it may be perfectly reasonable in isolation, it is difficult to reconcile with the standard reform argument. You can't believe that the culling process is this effective and still accept the premises that education should follow the corporate model and large scale firings of tenured teachers will significantly improve our schools.

Moving past that paradox, how do corporations handle the occasional incompetent? Even if we stipulate to an amazingly effective culling process, a few losers will inevitably make it through. Anyone who has logged some time in cubeville will tell you these people can be difficult to dislodge. Removing them disrupts the company, hurts morale and entails admitting a huge mistake. Faced with with all this, companies often employ the same strategies that reformers decry in schools -- they either shuffle incompetents off into meaningless make-work jobs or they leave them where they are.

Most of the incompetents go unseen by the general public but there are some conspicuous exceptions, something I'll save for the next post.

A Partial N-space of Eduction Reform -- another preblogged footnote

If we are going to have an intelligent conversation about education (which at this point would be a refreshing change of pace), we have to start by thinking about the n-space. There are multiple dimensions that have to be considered here. As long as the debate fails to acknowledge them or approaches them in a sloppy way, the analyses will continue to be fatally flawed.

We could look at this on the level of classes or individual students, but in this case it probably makes the most sense to think of each school as representing a point in this multidimensional space. We assume these points are more or less fixed with respect to some of these dimensions (grade level, population density [rural/suburban/urban], demographics, region, etc.) but we like to believe that we can change the position of these points with respect to other dimensions (retention, discipline, standardized test scores, etc.).

Why is it so important to think in terms of this multidimensional space? Because there are few meaningful statements that are valid across these various axes. When Doug Staiger and Jonah Rockoff (here via Ray Fisman) made radical suggestions about teacher hiring policies, they based them on a study of arguably the two least representative school districts in the country. Even if the rest of the study were sound (rather than being a train wreck, but more on that later), the findings would be worthless for most of the country.

Worse yet, when you make a substantial change in educational policy, there is a wide range of relationships between the effects you see along different dimensions, including possible inverse relationships between retention and other measures of school performance (the fastest and most reliable way for a school to improve its performance is to get rid of the students it can't handle).

Even with the most careful of reasoning, the most clearly stated questions and the most closely examined assumptions, this kind of complex, multidimensional system can react to new conditions in dramatic, counterintuitive ways. If you approach it with the kind of sloppy thinking that has dominated the education debate, you are asking fate to do some very bad things.

but the NYT has a roundtable on tenure. Pretty much the same old lines. With the exception of Kezar (who does, at least, ask some good, tough questions), no one adds anything original or insightful to the discussion, but there is, I suppose, some value in seeing where the debate has come to a dead stop.

A quick note on tenure and the economics of deferred compensation

(Joseph may be through with this, but I'm just getting started.)

One of the many weird things about the exceedingly weird tenure debate is the way many (hell, most) of the participants talk about tenure as a gift to teachers rather than a form of compensation that's part of a highly competitive market. *

All forms of deferred compensation offer two attractive features to employers: they reduce the initial cost and they encourage retention. Both of these features are particularly attractive to school administrators who work in an incredibly labor-intensive industry, can't offer big salaries, often require employees to move to out-of-the-way towns and can't afford to have their best people move on the moment a better offer comes along.

If you eliminate tenure you will have to come up with an alternative compensation plan that accomplishes the same thing and with the possible exception of Tyler Cowen, no one seems to show any interest in what that alternative might be.

Thinking about teacher layoffs -- the logistics of staffing

Regarding Seyward Darby's recent article on teacher layoffs, you can find posts on why she doesn't understand economics here and here, posts on the questionable data and analysis behind her position here and here, posts pointing out the problems with the movement she endorses here and here (from Darby's own magazine) and an explanation of why the tenure 'reform' she champions would be unfair and unethical here.

But I don't believe anyone has pointed out what a logistic nightmare she wants to get us into.

Let's take the plan that Darby favors and throw in some reasonable numbers:

We take our already somewhat understaffed schools and lay off, let's say, 200,000* teachers selected based in part on some quality metric. We then run the schools severely understaffed for the next year or so until state revenues recover.

That 200K will be made up of three groups, the good, the bad and the better-than-nothing. The good are effective teachers who end up on the list through a combination of bad luck, bad metrics and bad administrators (go here to see how the last two can work together). The bad are teachers at the very bottom of the quality scale. The better-than-nothing are teachers who aren't all that effective but are probably still at least as good as most of the people you could get to replace them.

Given the flaws in our system of ranking teachers and the innate difficulty of the problem, a fair number of good teachers will end up on the list. Likewise, given the problems with recruiting teachers for problem schools, better-than-nothing teachers will continue to make up a large part of it.

The upshot of all this is that, given population growth and the high level of teacher attrition, you will need a substantial number of the people you laid off to come back if you are to have any hope of meeting staffing targets. This wasn't as much of a problem under last-in/first-out for a couple of reasons. First, the attrition rate for new teachers was so high that many of the teachers you laid off wouldn't have been there in a couple of years even if you hadn't let them go. Second, leaving under last-in/first-out carries minimal stigma. For those who really wanted to it was easy to get back into the field a year later.

Under the 'reform' system, there is a serious stigma and a deadly asymmetry of information problem. Keep in mind that administrators are basically stuck with new hires for a year (you try finding a certified replacement in, say, November). They know that a teacher laid off under that system might turn out to be first rate, but do they really want to take the chance?

Let's say 100,000 of the laid-off teachers fell into the need-them-later category. We have screwed these teachers out of contractually obligated compensation, scapegoated them for all the problems in the education system and made them unemployable in their chosen field. Would you come back under those circumstances?

Of course, the impact is not limited those laid off. Other than the satisfaction that comes with the job, the primary attraction of teaching is job security. For generations, teachers have self-selected to be risk-averse. Faculty rolls mainly consist of people who have willingly traded any significant chance of promotion for the stability to start a family, buy a house, and spend thirty or forty years doing something they're good at.

In an industry dependent on a very large number of highly skilled labourers, this is not a bad situation, but putting those bigger, long-term questions aside, what is likely to happen when the economy recovers and we try to start restaffing? We were having trouble maintaining adequate levels before the lay-offs. Then we permanently removed around 200,000 teachers from the pool (many of whom we would have liked to have had back later). Now we are trying to hold on to teachers after having unilaterally removed a valued part of their compensation and established the precedent that contractual obligations to educators don't need to be honored.

Of course, the reformers will assure you that they have a set of programs that will solve the retention problem, but keep in mind these are the same people who have been solving this problem for a decade and their track record is nothing if not consistent.

According to this NCES paper, we were hiring around 200,000 new teachers a year before the economy collapsed. That was a difficult and expensive proposition and we often had to compromise quality to make that number. Now think about doubling or tripling the number of vacancies.

This is not going to work out well.

More on compensation -- tenure edition

We often hear that the labor market will be fine if we just let market forces fix the problem. The assumption is that workers will consider the available jobs, weigh the requirements of each job against the compensation and rationally choose the optimal position. But the assumption behind that assumption is that employers will honor contracts, particularly regarding compensation.

This compensation can take a number of forms (salary, bonuses, pensions, benefits, stock options, etc.) and can be paid out over a variety of schedules. The only thing that matters is that the agreed-upon compensation is paid if the employee completes the agreed-upon duties.

Guarantees of job security are often part of compensation. Think of football coaches and CEOs. Failing to honor these guarantees is no different in either principle or practice from taking a delivery then failing to pay the agreed-upon price.

With that in mind, check out the latest from Colorado:
While other states have tried to modify tenure, Colorado's law was the boldest education reform in recent memory, according to Kate Walsh, the president of the Washington-based National Council on Teacher Quality, which promotes changing the way teachers are recruited and retained, including holding tenured teachers accountable with annual reviews.

Walsh thinks Colorado is now at the head of the pack in the second round of the Obama administration's Race to the Top competition, a $4.35 billion pot of stimulus money designed to prod just such changes.

"If I was a betting woman, I would absolutely put Colorado in first place," she said.

The new law requires teachers to be evaluated annually, with at least half of their rating based on whether their students progressed during the school year. Beginning teachers will have to show they've boosted student achievement for three straight years to earn tenure.

Teachers could lose tenure if their students don't show progress for two consecutive years. That won't be a possibility until 2015, however, because lawmakers slowed down the process under political pressure from the teachers' union. Teachers can appeal dismissal all the way to the state Supreme Court, and school districts have the burden of proving why they should be terminated.
Just a friendly reminder, if you are going to do business with Colorado, insist on being paid first and make sure to count the money. The state isn't that big on honoring its contracts.

Career paths, educational reform and unintended consequences

This post by Joseph about career paths for researchers reminded me of some disturbing trends in career paths on the other side of academia, teaching.

In primary and secondary education, you can have a completely successful career by any conceivable standard and never get a single promotion. You can easily spend your entire professional life doing the same job with the same title. That might even be the ideal.

For a field requiring a degree, additional coursework and certification, this is an extraordinarily limited career path. To make up for that we have traditionally offered the following:

1. Reliable income that increases at an agreed-upon rate annually.

2. A high level of job security after a certain number of years (though this is somewhat offset by low job security before reaching tenure).

As well as creating a career path that didn't depend on promotion (and therefore largely avoided the Peter Principle), this emphasis on deferred, but steady compensation meant schools could minimize their investment in new, untested personnel (most really disastrous teachers do not make it to the tenure mark).

Two of the central tenets of the current move for education reform are elimination of tenure and replacing raises based on experience and education with merit pay. This leaves us with a career path that offers no real chance of promotion, no job security and wildly variable pay based on metrics that are largely out of the teacher's control and can easily be gamed by a biased administrator (see here).

Another reason to abolish tenure

You may have seen this story from Inside Higher Ed (via Andrew):
The biology professor at Louisiana State University at Baton Rouge gives brief quizzes at the beginning of every class, to assure attendance and to make sure students are doing the reading. On her tests, she doesn't use a curve, as she believes that students must achieve mastery of the subject matter, not just achieve more mastery than the worst students in the course. For multiple choice questions, she gives 10 possible answers, not the expected 4, as she doesn't want students to get very far with guessing.

Students in introductory biology don't need to worry about meeting her standards anymore. LSU removed her from teaching, mid-semester, and raised the grades of students in the class. In so doing, the university's administration has set off a debate about grade inflation, due process and a professor's right to set standards in her own course.
Anyone who has spent time behind a podium can give you examples of parents and administrators pressuring teachers to raise a students' grades. The most egregious case I know of took place at a highly prestigious and very pricey prep school, but even in public schools in the days before school choice, a call from a parent to a principal about a grade would often result in an unpleasant employer-employee chat and the loss of a badly needed hour of grading and lesson planning.

I remember those meetings, and I remember thinking how much easier it would have been to stand up to that pressure if only the administrator had had more authority to fire teachers. Thank God for education reform.
